Update On Breach of By-Laws by the Hotel
Breach of By-Laws by Hotel Update - re Health Group using Kooindah Waters Facilities
Following Association Committee meeting this morning we have begun the process to issue the Hotel with a Notice to Comply. The first step in this process (as has been recommended by BCS) is to issue a warning letter to cease all activities that breach the By-Laws by Friday, 6th September.
Should the hotel fail to comply, a Committee Meeting notice will then be issued to all owners. This notice requires no action from owners. Subsequently, the Association Committee, as mandated by the Act, will vote to issue a Notice to Comply.
Please be aware that this is a formal procedure mandated by NSW Fair Trading and as recommended by our Strata manager, BCS. We are required to follow due process and ask residents to be patient as we work through the legal requirements to issue the Notice to Comply.
The Association Committee will continue to update residents with any news or developments as they occur.
Residents are encouraged to use the facilities as usual. Should any issues occur, please contact us at info@kooindahwaters.com, providing details like the date, time, and location of the incident.
